2. Description of Service

Animaps is an AI-powered platform that enables users to create professional map animations using natural language commands. Our Service includes:

• AI-powered map animation creation tools
• Natural language processing for animation commands
• Multiple map styles and customization options
• Video export functionality
• Template library and animation management

3. User Accounts

To access certain features of the Service, you may be required to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account information.

• Reverse engineer, decompile, or disassemble any portion of the Service
• Use the Service to compete with or create a competing service
• Capture, record, screenshot, or otherwise reproduce preview animations displayed in the Service. Preview animations are for testing and review purposes only. Any attempt to capture, record, screenshot, or reproduce preview animations through any means (including but not limited to screen recording software, screenshot tools, browser extensions, or any other method) is strictly prohibited and constitutes a violation of these Terms. Only animations rendered through the official render feature may be used for commercial or public purposes.
• Remove, obscure, or attempt to remove any watermarks, copyright notices, or other proprietary markings from preview animations or rendered content
• Use preview animations or any captured content from previews for commercial purposes, public distribution, or any purpose other than testing and reviewing your animation within the Service

Important: Preview animations are protected by copyright and are intended solely for internal testing and review. Any unauthorized capture, recording, or reproduction of preview animations may result in immediate termination of your account and may subject you to legal action. To obtain a usable animation for commercial or public purposes, you must use the official render feature, which requires credits and produces a properly licensed, high-quality output.

5. Intellectual Property Rights

Our Rights: The Service and its original content, features, and functionality are owned by Animaps and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content: You retain ownership of any animations, videos, or other content you create using the Service ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of providing and improving the Service.

Map Data: The Service uses map data from third-party providers (including OpenStreetMap and MapLibre). Your use of map data is subject to the terms and conditions of these third-party providers.

6. Subscription and Payment

Free Tier: We offer a free tier of the Service with limited features. Free tier users may have restrictions on the number of animations, export quality, and available features.

Paid Subscriptions: We offer various paid subscription plans with different features and limits. By subscribing to a paid plan, you agree to pay the fees specified for that plan. Subscription fees are billed in advance on a monthly or annual basis, as selected.

Automatic Renewal: Unless you cancel your subscription, it will automatically renew at the end of each billing period. You authorize us to charge your payment method for the renewal period.

Refunds: Subscription fees are generally non-refundable. However, we may provide refunds at our sole discretion in exceptional circumstances.

Cancellation: You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period, and you will continue to have access to paid features until that time.

7. Credits System

The Service uses a credits system to create animations. Credits are consumed based on the complexity of your animation (number of actions, duration, etc.). Credits:

• Are allocated based on your subscription plan
• May roll over to the next billing period according to your plan's terms
• Cannot be transferred between accounts
• Expire according to your plan's terms
• Cannot be refunded or exchanged for cash

8. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding the collection and use of your information.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not warrant or make any representations regarding the use or the results of the use of the Service in terms of correctness, accuracy, reliability, or otherwise.

We are not responsible for the accuracy, completeness, or usefulness of any information provided by the Service, and we are not responsible for any decisions made based on such information.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ANIMAPS, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICE (OR, IF WE CHOOSE, TO SUPPLYING YOU THE SERVICE AGAIN) IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

11. Indemnification

You agree to defend, indemnify, and hold harmless Animaps, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to delete your account.

All provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
