Welcome to Animaps ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, services, and applications (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Animaps, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

2. Description of Service

Animaps is an AI-powered platform that enables users to create high-quality map animations using natural language commands. Our Service includes:

• AI-powered map animation creation tools
• Natural language processing for animation commands
• Multiple map styles and customization options
• Video export functionality
• Template library and animation management

AI Features: Some features of the Service use third-party AI services (currently OpenAI) to process your prompts and related inputs and generate outputs. You agree not to use AI features in a way that violates any applicable law or third-party terms. AI-generated outputs may be inaccurate or incomplete and are provided for informational/creative purposes only; you are responsible for reviewing outputs before use.

3. User Accounts

To access certain features of the Service, you may be required to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Create only one account per person. Creating multiple accounts (including using different email addresses, email providers, or identity providers) to obtain additional free credits, bypass usage limits, or circumvent a suspension is strictly prohibited
• Use a valid, permanent email address. Accounts registered with disposable or temporary email services may be suspended without notice

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account information.

Enforcement: We reserve the right to suspend or terminate accounts that violate these rules. Repeated violations, including creating new accounts after a suspension, may result in additional measures such as IP-based restrictions. After an account is deleted, the same email address cannot register a new account for 15 days.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable federal, state, local, or international law or regulation
• Transmit any material that is defamatory, obscene, offensive, or otherwise objectionable
• Impersonate or attempt to impersonate another user, person, or entity
• Engage in any automated use of the system, such as using scripts to send comments or messages
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service or any other accounts, computer systems, or networks
• Use the Service to create content that infringes on intellectual property rights
• Use the Service to create content that promotes illegal activities, hate speech, or violence
• Reverse engineer, decompile, or disassemble any portion of the Service
• Use the Service to compete with or create a competing service
• Capture, record, screenshot, or otherwise reproduce preview animations displayed in the Service. Preview animations are for testing and review purposes only. Any attempt to capture, record, screenshot, or reproduce preview animations through any means (including but not limited to screen recording software, screenshot tools, browser extensions, or any other method) is strictly prohibited and constitutes a violation of these Terms. Only animations rendered through the official render feature may be used for commercial or public purposes.
• Remove, obscure, or attempt to remove any watermarks, copyright notices, or other proprietary markings from preview animations or rendered content
• Use preview animations or any captured content from previews for commercial purposes, public distribution, or any purpose other than testing and reviewing your animation within the Service

Important: Preview animations are protected by copyright and are intended solely for internal testing and review. Any unauthorized capture, recording, or reproduction of preview animations may result in immediate termination of your account and may subject you to legal action. To obtain a usable animation for commercial or public purposes, you must use the official render feature, which requires credits and produces a properly licensed, high-quality output.

5. Intellectual Property Rights

Our Rights: The Service and its original content, features, and functionality are owned by Animaps and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content: You retain ownership of any animations, videos, or other content you create using the Service ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of providing and improving the Service. For Uploaded Materials expressly accepted below, the following broader license applies.

6. Subscription and Payment

Payment Processor: Payments and subscription management are processed via Lemon Squeezy (including customer portal and payment method updates). Your payment may be subject to Lemon Squeezy's terms and policies.

Free Tier: We offer a free tier of the Service with limited features. Free tier users may have restrictions on the number of animations, export quality, and available features.

Paid Subscriptions: We offer various paid subscription plans with different features and limits. By subscribing to a paid plan, you agree to pay the fees specified for that plan. Subscription fees are billed in advance on a monthly or annual basis, as selected.

Automatic Renewal: Unless you cancel your subscription, it will automatically renew at the end of each billing period. You authorize us to charge your payment method for the renewal period.

Refunds on subscription plans: Not happy with Animaps? Contact us within 14 days of your first purchase and we'll refund you in full, no questions asked — provided you've used fewer than 5 (Lite), 10 (Starter), 15 (Pro) or 20 (Premium) credits on a monthly plan, or twice that on a yearly plan. One full refund per customer. All other refund requests are reviewed case by case at our discretion — we may offer a full or partial refund, or decline. When a refund is issued, the subscription ends immediately and remaining credits are removed. Payment disputes may result in the account reverting to the Free plan. Nothing in this policy limits any non-waivable statutory rights that may apply in your country.

Refunds on credit packs: Credit packs are one-time purchases and their credits never expire. Contact us within 14 days of buying a pack and we'll refund it in full, provided you've spent fewer than 5 credits from a Mini pack, 10 from a Value pack, 15 from a Mega pack or 20 from a Bulk pack. Refunded credits are removed from your balance. Beyond those thresholds we don't refund packs, as the credits have been used to produce videos you keep. Requests outside these conditions are reviewed case by case at our discretion. Your plan's own credits are always spent before pack credits, so a pack stays untouched until your plan credits run out. Nothing in this policy limits any non-waivable statutory rights that may apply in your country.

Cancellation: You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period, and you will continue to have access to paid features until that time.

7. Credits System

The Service uses a credits system to create animations. Credits are consumed based on the complexity of your animation (number of actions, duration, etc.). Credits:

• Are allocated based on your subscription plan
• May roll over to the next billing period according to your plan's terms
• Cannot be transferred between accounts
• Expire according to your plan's terms, except credits bought as one-time packs, which never expire
• Cannot be exchanged for cash
• Are not refundable on their own, except for credit packs refunded under the credit-pack policy in section 6

8. Map Data Sources and Attribution

Animations you create use map data from the following sources. Each exported video carries this notice in its file metadata, and the sources below are the full list:

• Map data © OpenStreetMap contributors, available under the Open Database Licence (ODbL). openstreetmap.org/copyright
• Contains data from GeoNames, licensed under CC BY 4.0, modified.
• Contains data from the European Commission Joint Research Centre, Global Human Settlement Layer (GHS-UCDB R2024A, GHS-FUA R2019A), licensed under CC BY 4.0.
• Contains data from geoBoundaries, licensed under CC BY 4.0, modified. Individual country datasets may instead carry CC BY-SA, the Open Database Licence (ODbL) or CC0, as stated by geoBoundaries for that country.
• Contains public domain data from Natural Earth and from NOAA National Centers for Environmental Information.
• Contains data from Wikidata, available under CC0 (public domain dedication).

Your responsibility when publishing. If you publish, broadcast or otherwise distribute a video created with the Service, you are responsible for carrying the attribution above with it. The licences that govern this map data require the credit to reach the people who see the work, and that obligation passes to you when you publish. The simplest way to satisfy it is to include the following line in the description or caption wherever you post the video:

We include this notice in every exported file's metadata so that it travels with the video, but we cannot control how or where you publish it. We accept no responsibility or liability for any claim arising from your failure to provide the required attribution.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding the collection and use of your information.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not warrant or make any representations regarding the use or the results of the use of the Service in terms of correctness, accuracy, reliability, or otherwise.

We are not responsible for the accuracy, completeness, or usefulness of any information provided by the Service, and we are not responsible for any decisions made based on such information.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ANIMAPS, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICE (OR, IF WE CHOOSE, TO SUPPLYING YOU THE SERVICE AGAIN) IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

12. Indemnification

You agree to defend, indemnify, and hold harmless Animaps, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete it from your account settings.

All provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Cambodia, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Cambodia.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
